Before buying at Banyan Tree Residences, verify three things on paper: where your deposits sit and what completion date the contract binds the developer to; what the building’s position means for flood, insurance and the view; and who runs it once owners move in, at what monthly cost. Each concern below starts from the developer’s own record for Banyan Tree Residences and ends with the document that settles it.
This page is a framework. Whether the building suits you is a separate conversation. Contact the desk at Miami Dossier for the current position on any building we cover.
In a building that is still rising, the buyer pays in stages long before any keys exist. Florida law requires those deposits to be held in escrow, and lets a developer spend the part above ten percent of the price on construction only where the contract allows it. Then read the completion clause. A target date in a brochure binds no one; the outside date in the contract, and the reasons it lets the developer move that date, are the promise that counts.
The deposit terms at Banyan Tree Residences: The deposit schedule is held by the desk and read with you before contract. Who stands behind the date: 400 Hibiscus Acquisitions, LLC; presented as Mast Capital and Curated JCZM Development. Ask for the towers it has finished, and when.
Read it against the Kempinski Residences Miami Design District dossier for the nearest comparison.
Position is what a Miami buyer pays most for and checks least. Three questions follow from it. The flood zone and the elevation certificate set the flood policy a lender will demand and the weight of the master insurance in the budget. A shoreline, where there is one, brings seawall and submerged land questions for the title commitment. And the parcels around the site decide whether the view you are buying stays open: the zoning next door is public, and so are the permits already filed.
Where Banyan Tree Residences stands, in the developer’s words: 400 Hibiscus Street, West Palm Beach, FL 33401; downtown, moments from the Intracoastal Waterway, near Worth Avenue, CityPlace and Royal Poinciana Plaza. Read it for what it offers and for what it exposes.
Every service a building advertises is a salary, a contract or a licence fee, paid by the owners through the association. Before contract, ask for the estimated first budget and set it beside the amenity list: staff hours for each space, the reserve line, the insurance line, and any brand or management fee with its escalator and its term. Then ask what happens if the operator leaves. A licence that can end and a budget that never priced the staff are where a monthly cost moves most after closing.
Who runs Banyan Tree Residences: Banyan Tree (Banyan Group); owners join The Sanctuary Club with priority access and preferred rates across more than 100 Banyan Group properties in more than 20 countries; a dedicated 24-hour host and service team trained in Banyan Tree hospitality. What the owners share: A full floor of wellness and spa: reflection and meditation garden, treatment rooms, rainforest showers, hammam, steam, sauna, soaking baths, cold plunge, cryotherapy, meditation dome, ice fountain; signature pool and cabanas; juice bar; garden bar and lounge; open-air cinema; golf simulator; speakeasy; rooftop amenity deck; children’s discovery garden; pet retreat; putting green.
Each concern closes with paper, not reassurance. For the first, the purchase agreement and the escrow agreement, read for the use of deposits and the outside date. For the second, the elevation certificate, the survey, the title commitment and the permits on neighbouring lots. For the third, the estimated budget and any licence or management agreement. The homes themselves: 88 private residences plus a penthouse collection: one- to four-bedroom corner residences with wraparound terraces, 10-foot ceilings, floor-to-ceiling impact glass, direct elevator entry in most; Yabu Pushelberg kitchens with Sub-Zero and Wolf; primary baths with rain shower and sculptural freestanding tubs. The desk puts these documents for Banyan Tree Residences on the table, reads them with you and your counsel, and says plainly where it would not proceed.
Verify the paper, not the rendering. Three concerns, three documents.

We hold no listings and we are not the developer. Contact the desk at Miami Dossier and we will tell you what applies to your situation, what does not, and where we would not proceed. On this topic that means the document before the opinion. Where a question is legal, tax or structuring, we introduce you to advisers who handle that properly rather than answering it ourselves.
