Can you rent out a new condo in Brickell or Edgewater?

For the owner who will be there part of the year and wants the rest of it to pay for something, without finding out the rules after closing.

This page explains. Whether the building suits you is a separate conversation. Contact the desk at Miami Dossier for the current position on any building we cover.

The short answer

Usually yes, on the terms the declaration sets, and those terms are not on the brochure. Of the five buildings on our file, ORA by Casa Tua is the one built for it: every residence fully furnished and move in ready, From $952,900, which the desk reads as the building where a buyer lands and rents or lives. Anantara Residences Miami publishes ~120 resort residences of one and two bedrooms beside ~100 condominium residences and ~50 hotel suites, From $1,800,000, and the word resort residence is the one to ask about. Cipriani Residences Miami, From $1,859,900, 619 Brickell by Nobu, From $2,950,000, and Villa Miami, From $5,750,000, publish no rental program on our file, which means the declaration's lease clause is the whole answer. The buyer reads that clause, the city's rules and the approval process before the contract, never after.

Where do the rental rules actually live?

In three documents, read in this order. The declaration of condominium sets the minimum lease term, how many times a year a home may be leased, whether a tenant may have a pet or a guest, and whether the association approves tenants. The rules and regulations add the register: who is recorded, how a fob is issued, what a move in costs. And the city's code decides whether a stay shorter than the declaration's minimum is lawful at that address at all, which is a question of zoning, not of the building's wishes. A building that publishes no rental program, as Cipriani, Nobu and Villa Miami do on our file, is not a building that forbids renting; it is a building whose answer is only in the declaration. Read Miami short-term rental rules, the short-term rental rules at Cipriani and the short-term rental rules at Villa Miami.

What does furnished or a hotel in the building change?

Two different things. Furnished, at ORA, removes the first cost of renting: the home arrives with the furniture a tenant expects, and a seasonal owner can hand the keys to a manager the week after closing. It does not change the lease minimum; that is still the declaration's. A hotel in the building, at Anantara, raises a different question. The developer publishes ~120 resort residences apart from the ~100 condominium residences, and the buyer asks what the word means at this building: whether a resort residence is sold with a rental management agreement, who runs it, how the revenue is split, how many nights the owner may use, and whether a condominium residence may join or must stay out. Those answers are in the condominium documents and the rental agreement, which the buyer reads before choosing which of the two lines to buy. A lender and an insurer read the same documents and price accordingly. Read the short-term rental rules at ORA, the short-term rental rules at Anantara and furnished or unfurnished.

Who approves the tenant, and what does the owner pay?

Where the declaration gives the association an approval right, the tenant applies, pays the fee the statute caps, and waits the days the statute allows; the owner collects nothing until that is done. The owner's costs are the ones a brochure never lists: a landlord form on the insurance policy instead of an owner occupied one, the association's move in deposit for each tenant, the manager's fee if the owner is away, and the tax questions for counsel: Florida's sales and tourist taxes on stays shorter than six months, federal income tax on the rent, and withholding where the owner is not a United States resident. None of that makes renting a bad idea; all of it belongs in the arithmetic before the contract. Who each building suits, and what you give up

ORA suits the owner who wants to rent from the first month, furnished, with Casa Tua on the door, From $952,900. You give up your own interiors and a delivery date on paper. Read the ORA buyer's guide and the Brickell zone page.

Anantara suits the owner who wants a hotel to run the home when they are away, From $1,800,000, and will read the rental agreement closely. You give up a lobby of your own. Read the Anantara dossier and the Edgewater zone page.

Cipriani, Nobu and Villa Miami suit the owner who will live there most of the year and rent only on the declaration's terms. You give up a program and keep the building's quiet. Read the Cipriani buyer's guide, the 619 Brickell by Nobu dossier and the Villa Miami dossier.

The desk reads the lease clause, the city's rule for the address and the rental agreement where one exists with the buyer before the reservation.

Common Questions

Questions buyers ask

Which Brickell condo is sold furnished?
ORA by Casa Tua publishes every residence fully furnished and move in ready, From $952,900, with Casa Tua as the hospitality operator under licence.
Does Anantara have a rental program?
The developer publishes ~120 resort residences beside ~100 condominium residences and ~50 hotel suites. What a resort residence carries is in the condominium documents and any rental agreement, which the buyer reads before choosing a line.
Can I rent my Cipriani condo by the week?
Only if the declaration's minimum lease term allows it and the city's code allows that stay at the address. Cipriani publishes no rental program on our file; the declaration answers.
Where is the minimum lease term written?
In the declaration of condominium, with the number of leases allowed per year. The rules and regulations add the register, the fees and the move in procedure.
Does the association have to approve my tenant?
Where the declaration gives it that right, within the statute's fee cap and time limit. The buyer reads the approval clause before the contract.
Does a rented condo cost more to insure?
The owner's policy moves to a landlord form, and the master policy is unchanged. The agent prices the change; the buyer asks before closing.
What taxes apply to renting a Miami condo?
Questions for counsel: Florida sales and tourist taxes on stays shorter than six months, federal income tax on the rent, and withholding where the owner is not a United States resident.
Can a lender object to my renting the home?
The loan is made on an occupancy type the borrower declares. Renting a home declared as a primary residence is a question for the lender before it happens, not after.
Which has the lowest published entry price?
ORA by Casa Tua, From $952,900. Then Anantara, From $1,800,000, Cipriani, From $1,859,900, 619 Brickell by Nobu, From $2,950,000, and Villa Miami, From $5,750,000.
Who should I call about renting out a condo in Brickell or Edgewater?
The sales team for the rental terms and any program, a Florida real estate lawyer for the declaration and the tax questions, an insurance agent for the landlord form, and the desk to read the documents with you before the reservation.
