Limited common elements at Villa Miami: storage, terraces, cabanas and the rights that travel with a residence

Some of what a residence comes with sits outside its walls. At Villa Miami, here is how those spaces are held, and why the declaration matters more than the floor plan.

This page is a framework. Whether the building suits you is a separate conversation. Contact the desk at Miami Dossier for the current position on any building we cover.

Three Kinds Of Space

Residence, common, reserved.

A Florida condominium like Villa Miami splits the building three ways: the residence, which is yours; the common elements, which all owners share; and between them the limited common elements, common property reserved for one residence or a few. Terraces, storage rooms, private elevator landings, cabanas and parking spaces often fall here. The declaration decides which is which, and that decides who repairs and insures each space.

Villa Miami: Villa Mezzo half floors of 3 to 4 bedrooms, ~2,940 to ~2,970 SF interior · Villa Piano full floors of 4 to 5 bedrooms, ~5,900 to ~5,960 SF interior · Villa Doppio duplexes · two terraces on every home, sunrise and sunset · 10 to 11 foot ceilings.

How A Space Is Assigned

At sale, by exhibit, or later.

Some are fixed in the declaration to a named residence. Others are assigned by the developer during sales, by recorded instrument and often for an added price. Some declarations let owners trade an assigned space with notice to the association; others forbid it. Ask for the exhibit at Villa Miami that lists your assignment. A storage room promised in an email is not assigned until the paper says so.

Villa Miami: 55 floors, 49 of them residential, three of club · ~70 homes by the public record, every one a half floor or a full floor · a three level penthouse at the crown.

Storage Rights

What goes in, and who can enter.

A storage room at Villa Miami comes with rules: what may be kept, with flammables usually barred; access hours; who holds a key; whether it is cooled. Contents are the owner’s to insure. Ask whether the room is caged or walled, above the flood line, and charged in the budget.

Villa Miami: ~20,000 SF over three club levels by Charles and Co · a Lake Como style floating pool vessel on the bay · MFG restaurant with private dining for residents · juice bar and coffee lounge · Italian thermal spa with plunge pools, steam and sauna · Technogym fitness with yoga, pilates and boxing studios · screening room, game room, library, boardroom · private vaults · on site estate manager and curator.

Who Pays And Who Decides

Upkeep, change, resale.

Many declarations charge the upkeep of a limited common element to the owner who uses it. Enclosing a terrace or adding heavy planters or a hot tub needs the board’s consent and often an engineer’s letter. At resale an assigned space normally passes with the residence; a separately sold one may not. The desk asks which spaces come with a residence at Villa Miami, on which exhibit, and whether any can be sold apart from it.

If it is not in the exhibit, it is not yours. It is a hope drawn on a plan.
