Limited common elements at South Flagler House: storage, terraces, cabanas and the rights that travel with a residence

Some of what a residence comes with sits outside its walls. At South Flagler House, here is how those spaces are held, and why the declaration matters more than the floor plan.

This page is a framework. Whether the building suits you is a separate conversation. Contact the desk at Miami Dossier for the current position on any building we cover.

Three Kinds Of Space

Residence, common, reserved.

A Florida condominium like South Flagler House splits the building three ways: the residence, which is yours; the common elements, which all owners share; and between them the limited common elements, common property reserved for one residence or a few. Terraces, storage rooms, private elevator landings, cabanas and parking spaces often fall here. The declaration decides which is which, and that decides who repairs and insures each space.

How A Space Is Assigned

At sale, by exhibit, or later.

Some are fixed in the declaration to a named residence. Others are assigned by the developer during sales, by recorded instrument and often for an added price. Some declarations let owners trade an assigned space with notice to the association; others forbid it. Ask for the exhibit at South Flagler House that lists your assignment. A storage room promised in an email is not assigned until the paper says so.

South Flagler House: Park Residences (floors 1 to 3): one- and two-bedroom configurations, about 1,800 to 3,000 square feet of interior space, facing the Norton Sculpture Garden; first-floor homes with private outdoor gardens; approximately 80 percent sold.

Storage Rights

What goes in, and who can enter.

A storage room at South Flagler House comes with rules: what may be kept, with flammables usually barred; access hours; who holds a key; whether it is cooled. Contents are the owner’s to insure. Ask whether the room is caged or walled, above the flood line, and charged in the budget.

South Flagler House: Vanishing-edge pool with Lake Worth Lagoon views and private cabanas; 25-metre lap pool, sun-shelf pool, hot tub; sunset terrace; entertainment lounge with catering kitchen; two private dining rooms; wine tasting room with lockers; library and card room; business centre and private offices; fitness centre with Pilates and yoga studios; indoor pickleball; golf simulator; full spa with treatment rooms, salon, vitality pools, ice plunges, steam and saunas; children’s playroom and teen lounge; sports court; media room.

Who Pays And Who Decides

Upkeep, change, resale.

Many declarations charge the upkeep of a limited common element to the owner who uses it. Enclosing a terrace or adding heavy planters or a hot tub needs the board’s consent and often an engineer’s letter. At resale an assigned space normally passes with the residence; a separately sold one may not. The desk asks which spaces come with a residence at South Flagler House, on which exhibit, and whether any can be sold apart from it.

If it is not in the exhibit, it is not yours. It is a hope drawn on a plan.
