A new building comes with promises the brochure never prints, because the statute prints them. At Caretta, here is what they cover, how long they last, and who enforces them.
This page is a framework. Whether the building suits you is a separate conversation. Contact the desk at Miami Dossier for the current position on any building we cover.
Florida’s condominium statute deems the developer to warrant that a new building is fit and merchantable for its intended use. For each residence at Caretta, the warranty runs three years from completion of the building. For the roof, the structure and the main mechanical, electrical and plumbing elements, it runs three years from completion or one year after owners take control of the association, whichever is later, up to five years. Contractors and suppliers give implied warranties of their own; appliances follow the manufacturer’s.

Purchase agreements often add a written limited warranty, a claims procedure, and exclusions such as hairline cracks in stone, normal wear and owner alterations. Some limit remedies or require arbitration. How the contract at Caretta sits beside the statute is a question for counsel before signing, not after a leak.
Caretta: 95 luxury residences; architectural-grade fixtures, freestanding tubs, custom stone vanities, recessed LED lighting; bedroom mix and size ranges not published in the intake materials.
A defect inside one residence is the owner’s claim. A defect in the roof, the facade, the garage or the shared systems at Caretta belongs to the association, which the developer controls until turnover; that is why the period runs past it. At turnover the developer hands over plans, warranties and records, and many owner boards hire an engineer to review the building before the periods run out.
Caretta: The homes are as the dossier records.
Florida requires written notice of a construction defect claim to the developer and the contractors before suit, with time to inspect and to offer a repair or a payment. Outer time limits on defect claims have been shortened in recent years, so the dates matter. Keep the closing, certificate of occupancy and turnover dates for Caretta in one file. The desk keeps them for every building it covers and introduces counsel when a claim is in view.
The warranty starts with the building, not the closing. Write the dates down.

We hold no listings and we are not the developer. Contact the desk at Miami Dossier and we will tell you what applies to your situation, what does not, and where we would not proceed. On this topic that means the document before the opinion. Where a question is legal, tax or structuring, we introduce you to advisers who handle that properly rather than answering it ourselves.
