The word has no legal meaning in Florida. It is a marketing term, and in this market it is applied generously.

There is no statutory definition of a penthouse in Florida, no minimum size, no required position in the building and no rule about how many a building may have. A developer may designate any residence a penthouse and many designate a great number of them.
What the declaration of condominium calls a unit is what it legally is. The word penthouse typically appears in the marketing and sometimes in the unit designation, and neither confers any right or attribute by itself.
If the word is doing work in a conversation about price, ask what specifically it refers to in that building.
The singular residence. One home at the top of a building, usually with the whole floor or more, usually with private outdoor space that no other residence has. This is what most buyers picture.
The collection. A tier of upper floor residences, sometimes eight or ten of them, marketed together as a penthouse collection. Baccarat Residences in Brickell carries eight. These are genuinely superior residences and they are not singular.
The upper floors. Some buildings apply the term to everything above a certain level, which can mean twenty or more residences. Here the word means little beyond a floor number.
All three are called penthouses in listings, in press coverage and in conversation. The gap between the first and the third is enormous.
Ceiling height. Upper floors often carry taller ceilings, sometimes considerably taller. This is the single change most felt on walking in and it is verifiable from the drawings.
Private outdoor space no one else has. A terrace is common; a private rooftop is not. Whether it is genuinely private and genuinely yours is a separate question and it is the most important one on this page.
Floor plate exclusivity. Whether you share the floor, and with how many. A full floor residence with a private lift lobby is a different life from a residence at the end of a corridor.
Volume. Double height space, a duplex or triplex arrangement, an internal stair. These change the character of a home more than square footage does.
A residence with all four is a penthouse in any sense of the word. A residence with none of them, on the top floor, is a top floor apartment.
Ask: how many residences in this building are called penthouses, and what do the others have that mine does not.
The answer is factual, it is available, and it reorders most conversations. A gallery presenting a residence as the penthouse will answer differently when the question is put that way.
If the answer is that there are eight, ask to see all eight. The differences within a penthouse collection are usually larger than buyers expect and the marketing rarely makes them obvious.
Price the ceiling height, the private outdoor space, the floor plate and the volume, because those are what you are actually buying. The word costs the developer nothing to apply.
